The Harvard Food Law and Policy Clinic has worked with national and state partners in Ohio to provide legal guidance on topics of significant confusion. Below are two fact sheets that outline who can donate food and what safety practices they should follow.

  • Ohio Food Donation Liability Fact Sheet – Ohio provides protection to food donors and distributors beyond that of the federal Good Samaritan Act. As of 2023, court cases database searches did not return a single court case related to food donation liability.
  • Federal Liability Protection for Food Donation – Food donation has been federally protected since 1996. There have been zero federal court cases related to food donation reliability since its passage.
